These General Terms and Conditions govern the contractual relationship between
You as a customer
and
HELMINGERs
Dog Training, Education & Education
for all the services offered.
§1 Scope of Application
(1) These General Terms and Conditions apply to all services provided by HELMINGERs Hundetraining, Ausbildung & Erziehung Widmannstrasse 15, 81829 Munich (hereinafter referred to as the "Provider"). (2) The conditions apply in particular to the following offers: Individual training Group training Introductory walk incl. inventory analysis Walking service with training PLUS pack time (3) By booking an offer, you accept these General Terms and Conditions. (4) The services offered are generally valid per dog-human team, unless expressly agreed otherwise.
§2 Subject of the contract
(1) The Provider provides services in the field of dog training, behavioral counseling and education. (2) These are services in the sense of a service contract in accordance with §611 BGB. (3) A specific training success is not owed, as this depends largely on your cooperation and the consistent implementation of the training content. A subjectively expected result does not constitute a defect and does not give rise to a claim for reimbursement. (4) Time specifications for training sessions are indicative.
§3 Deployment of trainers and staff
(1) The Provider is entitled to use its own employees or qualified vicarious agents to provide the agreed services. (2) The allocation of trainers and employees is carried out exclusively by the provider according to organisational and professional aspects. (3) There is no entitlement to the performance of the service by a specific person. (4) The provider makes every effort to take into account appointment requests and personal preferences as far as possible, but cannot guarantee their implementation. (5) Even in the case of appointments that have already been arranged, a change of the executing employee may take place for organisational reasons.
§4 Conclusion of Contract
(1) The presentation of the services on the website does not constitute a legally binding offer. (2) A contract is concluded by confirming an appointment by e-mail or WhatsApp or by completing an online booking process. (3) The Provider reserves the right to reject requests without giving reasons.
§5 Prices and Terms of Payment
(1) The prices published at the time of booking apply.
(2) The provider uses the small business regulation according to §19 UStG, therefore no VAT is shown.
(3) In the case of online bookings, payment is due immediately upon completion of the booking process and must be made in advance.
(4) In the case of manual bookings (e.g. making an appointment by e-mail or WhatsApp) as well as subscriptions with invoicing, the payment term is 14 days from the invoice date, unless otherwise agreed.
(5) The Provider may only bindingly confirm or carry out appointments and services after receipt of payment, unless automatic payment has been agreed.
(6) The Provider shall be entitled to assign trade receivables in whole or in part to third parties (e.g. within the framework of factoring). In this case, payments with a debt-discharging effect can only be made to the respective claim holder.
§5a Pricing Plans and Subscriptions
For the offers "Flea Box", "Pack Time" and "Dog Service with Training PLUS", price plans can be taken out in the form of packages and subscriptions. These are ongoing, fee-based services.
By taking out a subscription, you enter into a recurring contractual relationship. Billing is done monthly in advance per calendar month.
If no automatic payment is made via the booking system, the remuneration will be due by invoice with a payment term of 14 days from the date of invoice.
Payment can be made via the means of payment stored in the booking system or by invoice. If you use external payment service providers (e.g. Stripe or PayPal), you agree to the automatic debit.
The subscription is concluded for an indefinite period of time and is automatically renewed for another calendar month at a time, unless it is cancelled in due time.
Termination is possible at any time with effect from the end of a calendar month. The time of receipt of the notice of termination is decisive.
Cancellation must be made no later than 7 days before the end of the calendar month in order to take effect at the end of the same month. Otherwise, the subscription will be automatically renewed for another calendar month.
If the payment is in arrears or a debit cannot be successfully made, the provider is entitled to temporarily suspend services until full payment has been made.
The right to extraordinary termination for good cause remains unaffected.
§5b Subscription, scope of support and billing
(1) The agreed subscription is valid per dog and per calendar month and is to be paid regardless of the number of days of care. This is especially true for months with different numbers of working days and public holidays.
(2) Billing shall be made monthly in advance for the respective calendar month. Invoices must be paid within 14 days from the date of invoice.
(3) You can book childcare models with two, three, four or five working days per week. Business days for the purposes of this Agreement are Monday to Friday.
(4) Care is provided all day from 08:00 a.m. to 05:30 p.m. A booking of half days is excluded.
(5) Your booking is binding for the agreed care days. If your dog does not participate on one or more booked days, there is no entitlement to replacement, make-up or refund.
(6) If you deregister your dog, the provider is entitled to allocate the childcare place to someone else. In the event of an interruption of the subscription, there is no entitlement to the previous childcare place.
(7) The subscription remains valid in full even if your dog does not participate in the care for reasons for which the provider is not responsible (e.g. illness or vacation), as the care place cannot be allocated elsewhere during this time.
(8) The dog daycare centre remains closed on public holidays. The provider does not provide support or training services on these days. There is no entitlement to substitute care, catch-up or reimbursement.
(9) Company holidays will be announced on the website in good time. No calculation will be made during the company holiday. The remuneration is adjusted on a pro rata basis for the calendar month in question.
(10) If the care begins during a current calendar month, billing is on a pro rata basis. From the following full calendar month, the subscription will be charged in full.
(11) The then current prices according to the offers and price plans published on the Website apply.
§6 Travel expenses
(1) Journeys of up to 15 km one way from Widmannstrasse 15, 81829 Munich are included in the price. (2) In addition, €1.50 per additional kilometre travelled (round trip) will be charged. (3) The basis for the calculation is the fastest route according to Google Maps. (4) In addition, an hourly fee of €79 will be charged for the travel time spent from a distance of more than 15 km. The travel time includes the outward and return journey and is calculated proportionately according to the actual time required.
§7 Appointment cancellations and cancellations
(1) Appointments must be cancelled no later than 48 hours before the agreed appointment. (2) In the event of a later cancellation or no-show, the full fee will be due, unless the appointment can be assigned elsewhere. (3) You reserve the right to prove that no or less damage has occurred. (4) As a matter of principle, fees already paid will not be refunded if an appointment is not kept due to personal circumstances (e.g. illness, dog heat or vacation) and the cancellation deadline has not been met. (5) Delays on your part are at your expense. The agreed training time is shortened accordingly. There is no entitlement to an extension or reduction of the fee.
§8 Withdrawal by the Provider
(1) The provider may cancel appointments if the minimum number of participants is not reached, the teacher is absent, extreme weather conditions prevent safe implementation, force majeure exists. (2) In this case, an alternative date will be offered or amounts already paid will be refunded.
§9 Participation requirements
(1) You confirm that your dog has valid dog liability insurance and that your dog is free of infectious diseases. The following applies to our pack time (group walking service): The dog must have stable social behaviour towards people and other dogs. It should be available in freewheel. The dog must be healthy, free of infectious diseases and free of parasites. Dogs with diarrhoea, vomiting or other symptoms of illness, as well as in heat, are not allowed to take part in training or care services. You undertake to have your dog dewormed regularly according to the veterinarian's recommendation. There must be valid vaccination protection, especially against distemper, parvovirus, hepatitis, leptospirosis and kennel cough. Appropriate proof of vaccination must be presented on request.
(2) You undertake to inform the provider completely about known special features of your dog before the start of the training. These include, in particular: aggressive behaviour towards people or animals biting incidents fearful behaviour hunting behaviour health restrictions official requirements.
(3) Changes in your dog's behaviour or state of health must be reported immediately.
(4) You undertake to properly remove your dog's excrement in public spaces.
§10 Training Equipment
(1) You provide suitable training equipment, in particular a stable leash, collar and/or chest harness, if necessary, tow leash (mandatory with chest harness), training reward (food, toys (fits into a jacket pocket, large). (2) If there are official requirements such as the obligation to wear a leash or muzzle, these must be observed.
§11 Training Safety
(1) The safety of people and dogs is a top priority during training. (2) The provider is entitled to order necessary security measures at any time. These include, in particular, leashing the dog, muzzle, tow leash, spatial distance to other dogs or persons. (3) You undertake to follow these safety instructions. (4) The Provider is entitled to discontinue or discontinue training sessions at any time for technical or safety-related reasons, in particular if there is a risk, instructions are not followed or a sensible implementation of the training is not guaranteed. In this case, the claim for compensation remains in place if the abortion was caused by you or your dog.
§12 Biting incidents
(1) If a biting incident or dangerous behavior of your dog occurs during the training, the provider can immediately stop the training, refuse further training sessions, and determine additional safety measures. (2) The dog owner shall be liable for any damage resulting from this.
§13 Training Structure
(1) The cooperation usually begins with a get-to-know-you walk including an analysis of the current situation. (2) Before starting, it may be required that a questionnaire about you and your dog be completed in full. (3) This is used for individual training planning.
§14 Group training
(1) Group training serves to stabilize behavior under distraction. (2) Participation is only possible after prior assessment by the provider. (3) The prerequisite for participation is socially acceptable behaviour towards people and other dogs. (4) The provider is entitled to exclude dogs from group training at any time if there is a danger, the training process is significantly disrupted or integration into the group is not possible. In this case, there is no entitlement to participation or replacement.
§15 Free-running and encounter training
(1) Exercises in free running or encounter training are carried out exclusively according to the assessment of the trainer. (2) Encounters with other dogs, people, wild animals or vehicles cannot be fully controlled despite the greatest possible care. (3) You are aware that training takes place in public spaces and that this can lead to situational risks.
§16 Duty to cooperate
(1) Your active participation is required for successful training. (2) You agree to follow the instructions of the trainer. (3) If training instructions are not followed, the provider may discontinue the training for safety reasons. (4) The Provider is entitled to terminate the training for professional reasons if a meaningful continuation is not possible.
§17 Dog walking service with training PLUS
(1) The walking service with Training PLUS takes place without the presence of the dog owner. (2) If you want to be present during the training session, it is individual training.
§17a Pack time, care and custody
(1) As part of the "pack time" offers and other care services (e.g. walking service with training PLUS), the dog is sometimes led and cared for in a group with other dogs.
(2) The care shall be provided in accordance with animal welfare requirements, in particular §11 of the Animal Welfare Act.
(3) You expressly agree that your dog may have contact with other dogs as part of the care and move in a socially guided group.
(4) Despite careful selection of dog groups and expert care, breed-specific or socially typical behaviour (e.g. scuffles, play injuries) may occur. A residual risk cannot be completely ruled out.
(5) The provider is entitled to exclude dogs from care or pack time if

there is a danger to other dogs or people

the dog is not sufficiently socially acceptable

there are health restrictions

official requirements preclude participation
There is no entitlement to participation in these cases.
(6) You undertake to hand over and pick up your dog punctually at the agreed times, unless a pick-up and delivery service has been agreed.
(7) If your dog is not picked up in time and you cannot be reached, the provider is entitled to continue to look after the dog for a fee or to take appropriate measures.
(8) In the event of an emergency (e.g. illness or injury to the dog), the provider is entitled to consult a veterinarian. You bear the costs incurred.
(9) You make sure that your dog is clearly identifiable (e.g. by microchip).
(10) The provider is entitled to take appropriate organisational and safety-related measures within the scope of care, in particular group composition, temporary separation of dogs, leashing or free running according to assessment
(11) The care is provided to the best of our knowledge and belief and in compliance with professional standards. However, complete supervision of each individual dog at all times cannot be guaranteed.
§18 Liability
(1) The Provider shall be liable without limitation for damages resulting from injury to life, limb or health, intent or gross negligence. (2) During the training, you remain an animal owner within the meaning of §833 BGB and are liable for all damage caused by your dog. (3) If, from the trainer's point of view, veterinary treatment is necessary and you cannot be reached, the provider is entitled to consult a veterinarian. You bear the costs incurred. (4) If a dog escapes during training or care, you will be informed immediately. If necessary, authorities can be consulted. No liability is assumed for escape or resulting damage or health consequences, provided that there is no intentional or grossly negligent conduct. (5) Injuries that occur during training, playing, free running or through encounters with other animals cannot be completely ruled out. Liability for this is excluded to the extent permitted by law.
§19 Participation at your own risk
(1) Participation in the training is at your own risk. (2) You are aware that dealing with dogs can involve a certain risk of injury.
§20 Copyright
(1) All training materials are protected by copyright. (2) Disclosure to third parties is not permitted without the consent of the provider.
§21 Cancellation Policy
Consumers have the right to withdraw from this contract within 14 days without giving reasons. The withdrawal period is 14 days from the conclusion of the contract.

Supplement to the revocation of services and subscriptions
In the case of services, in particular in the context of appointment bookings or subscriptions, you expressly agree that the service can begin before the expiry of the withdrawal period.
You are aware that your right of withdrawal expires prematurely as soon as the service has been fully performed.
In the case of partially rendered services, an appropriate amount must be paid in the event of revocation, which corresponds to the proportion of the services provided up to the revocation in relation to the total amount.
§22 Consequences of revocation
If you cancel this contract, all payments will be refunded within 14 days. If you have requested that the service begins during the withdrawal period, an appropriate amount must be paid for services already provided.
§23 Final Provisions
(1) German law shall apply. (2) The statutory places of jurisdiction apply to consumers. (3) For entrepreneurs, the place of jurisdiction is Munich. (4) Should any provision of these GTC be invalid, the remainder of the contract shall remain valid.
